Welcome to Cochain Books, a division of Cochain LLC, registered in the State of Texas, USA. These Terms of Service govern your use of our website at www.cochainbooks.com and the purchase of our children's book publishing services. By accessing the website or engaging our services, you agree to be bound by these terms.

1. Our Services

Cochain Books provides a done-for-you children's book publishing service, including professional manuscript editing, custom illustration, book formatting, and publishing to Amazon KDP and IngramSpark. Services are offered in four packages:

•        Story Seed ($299) — Template-based illustrations, eBook format, estimated 3–4 weeks.

•        Little Spark ($499) — Custom illustrations, eBook and Paperback, estimated 3–4 weeks.

•        Magic Maker ($999) — Custom illustrations, eBook, Paperback and Hardcover, estimated 4–6 weeks.

•        Dream Weaver ($1,499) — Custom illustrations, all formats including Audiobook, estimated 6–10 weeks.

All timelines are estimates from the date production officially commences (i.e. receipt of signed agreements, deposit, and all story materials). Delays caused by the client's response time do not shorten the production commitment.

2. Agreements & Acceptance

Purchasing a package constitutes acceptance of these Terms of Service and the execution of the following project-specific documents, which govern the detailed terms of your engagement:

•        Client Service Agreement — defines the scope, revision policy, and payment schedule for your package.

•        Publishing & Distribution Agreement — governs the grant of publishing rights, royalty structure, and reversion terms.

•        Parental Consent & Publicity Release Form — covers consent for use of the child's likeness in illustrations and optional marketing.

In the event of any conflict between these Terms of Service and the signed project agreements above, the signed project agreements take precedence.

3. Payment Terms

All packages are subject to the following payment structure:

•        Deposit (50% of total package price): Due upon signing of agreements. Production does not commence until the deposit is received.

•        Final Payment (50% balance): Due upon delivery of the final proof for client review. Publishing submission does not occur until the final payment is confirmed.

•        Accepted payment methods: Credit/Debit Card, PayPal, Zelle, or bank transfer.

•        Invoices are issued for each payment milestone and serve as your official receipt.

4. Cancellation & Refund Policy

Due to the custom and labour-intensive nature of our services, the following cancellation policy applies:

•        Before production begins: Full deposit refunded, less a $50 administrative processing fee.

•        After manuscript editing has commenced: 50% of the deposit is non-refundable.

•        After illustration has commenced: The full deposit is non-refundable.

•        After final proof delivery: The final payment is non-refundable once the final proof has been delivered and approved.

Cochain Books reserves the right to cancel a project prior to commencement at its sole discretion, in which case any deposit paid will be refunded in full.

5. Revision Policy

Each package includes a defined number of revision rounds at no additional cost:

•        Manuscript: Up to 2 rounds of feedback and revision.

•        Illustrations: Up to 2 rounds of minor revisions per illustration (colour, minor character adjustments). Major redesigns or story changes after illustration has commenced will be quoted separately.

•        Cover Design: Up to 2 rounds of revision.

•        Additional revision rounds beyond the included allowance are billed at $75 per hour.

Revisions are managed through our structured Client Feedback Form, which is provided at each review stage. Approval of a proof at any stage constitutes acceptance of that deliverable.

6. Intellectual Property & Ownership

Cochain Books operates on a True Authorship model. The following ownership terms apply:

•        The child author retains 100% ownership and copyright of the story and characters from the moment of creation.

•        Upon completion of the project and receipt of final payment, the client receives 100% of all net royalties generated from book sales on Amazon and other retail platforms.

•        Cochain Books retains ownership of its proprietary layout files, cover design templates, and production processes. Final print-ready PDF files are delivered to the client upon project completion.

•        All illustrations produced by our contracted illustrators are created under Work-for-Hire agreements and are fully owned by Cochain Books, which licenses them exclusively to the client for their published book.

7. Marketing & Portfolio Use

Cochain Books may wish to celebrate your child's achievement in our marketing materials. The following rules apply:

•        We will never feature your child's name, likeness, story, or photographs in any marketing, social media, or promotional material without your explicit written consent.

•        Your consent preferences are captured in the Parental Consent & Publicity Release Form at the start of each project.

•        You may update or withdraw your consent at any time by providing 30 days' written notice to info@cochainbooks.com.

•        Testimonials and reviews submitted to Cochain Books may be used in marketing materials based on the usage consent confirmed at the time of submission.

8. Influencer & Ambassador Partnerships

Cochain Books occasionally offers complimentary book productions to content creators and influencers in exchange for social media coverage. All such arrangements are governed by a separate Influencer & Brand Ambassador Agreement, which sets out the deliverables, posting requirements, FTC disclosure obligations, and consequences of non-fulfilment. These terms supplement but do not replace these Terms of Service.

9. Production Timelines & Third-Party Platforms

Production timelines are estimates and may be affected by the speed of client feedback and approvals. Cochain Books is not liable for delays caused by third-party platforms including Amazon KDP and IngramSpark. Once a book is submitted to these platforms, review and publication is subject to their independent processes, which typically take 3–7 business days.

Cochain Books does not guarantee specific sales volumes, revenue, or search rankings on any retail platform.

10. Contractor Confidentiality

All illustrators, editors, and other production contractors engaged by Cochain Books on your project are bound by signed Non-Disclosure Agreements and Work-for-Hire Agreements. They are contractually prohibited from sharing, publishing, or using any client materials — including your child's story, photographs, or personal details — outside of the production process.

11. Limitation of Liability

Cochain Books' total liability under any claim arising from its services shall not exceed the total fees paid by the client for the project in question. Cochain Books is not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of earnings, loss of data, or reputational harm. This limitation applies to the fullest extent permitted by applicable law.

12. Governing Law & Dispute Resolution

These Terms of Service are governed by the laws of the State of Texas, United States. Any disputes arising from or relating to these terms or your use of Cochain Books' services shall be subject to the exclusive jurisdiction of the courts of Fort Bend County, Texas. Both parties agree to attempt good-faith resolution before initiating formal legal proceedings.

13. Changes to These Terms

Cochain Books reserves the right to update these Terms of Service at any time. The most current version will always be available at www.cochainbooks.com/terms-of-service. Continued use of the website or services following any update constitutes acceptance of the revised terms. For active projects, the terms in effect at the time of the signed Client Service Agreement shall apply.
